TERMS & CONDITIONS

Welcome to Oh Bisou! (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile app (if any), and services (“Platform”). By accessing or using the Platform, you agree to follow and be bound by these Terms. If you do not agree, you may not use our Platform.

We are OH BISOU PRIVATE LIMITED, a private limited company with brand name OH BISOU!, owned by Aadya Bajoria, address 404, Nemi Sagar Colony, Queens Road, Vaishali Nagar, Jaipur – 302021, Rajasthan, India, contact +91 9636119244 (WhatsApp/Phone).

We run an online-only store on Shopify, import ready-made clothes from around the world, no Cash on Delivery (COD), no returns, exchange only for size or damage with unboxing video for damage, and OH BISOU! trademark is applied for and process is on.


1. Eligibility

You must be 18 years or older (or the age of majority where you live) to make an account or buy items. If you are under 18, you can use the Platform only if a parent or guardian is involved and agrees to these Terms. We can stop access or cancel accounts if we find misuse or wrong age details. You must be a real person; no bots, fake accounts, or automated tools allowed, and we can check and block if needed.

2. Account and Your Duty

You may need an account to shop, and you must give true, full, and latest details. You are responsible for keeping your login safe, and all actions on your account are your duty. Tell us right away if someone else uses your account. We can suspend or end accounts that give false details or misuse the Platform. You cannot share your account with others or make extra accounts to get more offers or discounts; we can end all such accounts without warning. You must update your details if they change (like address or phone), as old details may cause order issues and you pay any extra cost.

3. How to Use the Platform

You agree not to do fraud, abuse, illegal things, or disturb others; not to copy, change, share, or use our content without permission; not to upload virus, bad code, or try to break security; and not to sell items bought here without our written okay. We can limit access, cancel orders, or suspend accounts if we see anything wrong. Do not scrape, crawl, or use robots to collect data from the Platform, as this breaks law and we can take action. Do not post bad reviews or false info about us online to hurt business, as we can sue for damage. You cannot use the Platform for business resale without our written deal.

4. Product Details and Price

We try hard to show correct details, price, stock, and pictures, but small changes (like color due to your screen settings) may happen. All prices are in Indian Rupees (INR) and include tax unless said otherwise. Prices, offers, and stock can change without notice. If a price is wrong, we can cancel the order and give refund, even after we confirm. Products may have small differences from photos due to batch or light, and this is not a defect. Custom duties or import taxes in your country are your duty to pay, and we do not refund them. We can limit how many items you buy of one type to stop bulk buying or resale.

5. Orders and Payment

Placing an order is just an offer to buy, and we can accept or reject based on stock, payment check, or any reason. Pay full amount at checkout with approved ways, no COD. We use safe third-party payment systems and do not keep your card or bank details. We check high-value or suspect orders extra, which may delay shipping. Failed payment cancels order auto; try again or contact us. You cannot change order after we dispatch (like address or item).

6. Shipping and Delivery

We show expected delivery time at checkout, but real time may change due to courier, customs, or other issues. Shipping cost (if any) is shown before you pay. Risk and ownership pass to you when we deliver to your address. If address is wrong and delivery fails, you pay extra cost. International orders may face customs hold; you handle clearance and pay fees. We are not responsible for loss or damage after courier takes item; track your package. No self-pickup; all orders ship only.

7. Cancellation, Exchange, and Refund

Cancellation: 
You can cancel before we send by contacting customer care, and if we agree, refund comes in 7–10 business days. After dispatch, no cancel, only exchange if eligible.
Exchange (No Returns): 
No returns at all; exchange only for size or damage. Ask within 7 days of delivery. Item must be new, not worn, not washed, with original tags, packing, invoice, and extras. For damage, send unboxing video. Cannot exchange lingerie, innerwear, beauty, personal care, jewellery, sale items (unless defective). One exchange per order only, no repeat. If item fails our check (used, no tag, smell), we send back and you pay shipping both ways.
Refund: 
We start refund after item passes our quality check, to original payment way or store credit/wallet. Bank or payment system may take more time. No refund for shipping cost unless our mistake. Gift cards or vouchers used mean refund as store credit only.

8. Offers, Discounts, and Vouchers

Each offer has its own rules we tell at the time, cannot change to cash, mostly one-time use. If you misuse (like many codes or resale), we cancel order or account. We can stop or change offers without telling. Offers cannot combine unless said. Expired code has no use, no extension. We can cancel offer if system error or abuse.

9. Our Rights on Content

All designs, pictures, logos, text, graphics, software on the Platform belong to us or our partners and are protected by law. OH BISOU! trademark applied for. You cannot copy, reproduce, or use for business without our written okay. User photos or reviews you post become our property to use (with credit if we want). No reverse engineering of our site or app.

10. Links to Other Sites

We may link to outside sites, but we are not responsible for their content or services. Your dealing with them is only between you and them. We can add affiliate links; we may earn commission, but no extra cost to you.

11. Our Liability Limit

As much as law allows, we are not responsible for indirect, extra, or special loss, including lost profit, data, or goodwill. Our max responsibility is the price you paid for the item or what law says. No liability for force majeure (war, flood, strike, pandemic). Platform may go down for maintenance, no claim for that.

12. You Protect Us

You agree to defend and keep us, our group companies, staff, and partners safe from any claim, loss, or cost from breaking these Terms, misusing the Platform, hurting others' rights, or fraud or unauthorized use of your account.

13. Ending Access

We can suspend or end your account and access without notice if we think you broke Terms or law. All your rights stop right away. On end, any pending orders cancel; refund if not shipped.

14. Law and Disputes

Indian law applies. First try to settle in peace. If not, only Jaipur courts decide. Any dispute goes to one arbitrator we pick, in Jaipur, under Arbitration and Conciliation Act, 1996, in English; decision final. No class action or group claims, individual only.

15. Changes to Terms

We can change Terms any time; new version with date will be on the page. If you keep using after change, you accept new Terms. We may email big changes, but check site yourself.
